Protection of Personal Data according to the LOPD
Uktena Tech, S.L. (hereinafter, Uktena), in compliance with the current regulations on personal data protection, informs that personal data collected through the forms on the websites: uktena.es, uktena.pt, and uktena.net, are included in specific automated files of users of Uktena’s services. The collection and automated processing of personal data are intended to maintain the commercial relationship and carry out information, training, advisory tasks, and other activities typical of Uktena.
These data will only be transferred to entities that are necessary solely to fulfill the aforementioned purpose. Uktena adopts the necessary measures to ensure the security, integrity, and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons regarding the processing of personal data and the free movement of such data.
The user may exercise the rights of access, opposition, rectification, and cancellation recognized in the said Regulation (EU) at any time. The exercise of these rights can be carried out by the user via email at privacy@uktena.ai or at the address: Edificio Lanzadera, Muelle de la Aduana s/n, 46024, Valencia (Spain). The user declares that all the data provided by them are true and correct and undertakes to keep them updated, communicating any changes to privacy@uktena.ai.

Data Controller
Uktena can act as either a Data Controller or a Data Processor for personal data under the General Data Protection Regulation 2016/679 (hereinafter, "GDPR").
For example, Uktena will be the Data Controller when a Client enters into a contract directly with us for processing that Client's data.
However, in most cases, due to the nature of our business, Uktena does not have a direct relationship with the data subjects and processes the end user’s personal data solely on behalf of clients and according to their instructions. Therefore, if you are an employee using our platform, we act solely as data processors of your data. Our Clients determine the purposes for using our Platform, as well as the data collection means within the scope of our platform's functions.
In the case of users browsing our website, Uktena will be the data controller for the data collected here, such as cookies or any data necessary to enjoy our content.
Data collected by service users
In cases where the user includes files with personal data on the shared hosting servers, Uktena is not responsible for the user’s non-compliance with the GDPR.
Data retention according to the LSSI
Uktena informs that, as a data hosting service provider, and pursuant to the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the time when the service provision began. The retention of these data does not affect the confidentiality of the communications and may only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to judges and/or courts or the Ministry that so requires.
The communication of data to State Forces and Bodies will be done according to the provisions of the personal data protection regulations.
Intellectual Property Rights
Uktena owns all copyright, intellectual property, industrial property, "know-how," and other rights related to the contents of the websites uktena.es, uktena.pt, and/or uktena.net and the services offered therein, as well as the necessary programs for their implementation and related information.
Reproduction, publication, and/or use not strictly private of the contents, in whole or in part, of the websites uktena.es, uktena.pt, and/or uktena.net is not allowed without prior and written consent.
Intellectual Property of Software
The user must respect third-party programs made available by Uktena, even if they are free and/or publicly available.
Uktena holds the necessary exploitation and intellectual property rights for the software.
The user does not acquire any rights or licenses over the contracted service, the software necessary for the provision of the service, or the technical information for monitoring the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only during the duration of these.
For any action that goes beyond the fulfillment of the contract, the user will need written authorization from Uktena, and the user is prohibited from accessing, modifying, viewing the configuration, structure, and files of Uktena’s servers, assuming civil and criminal liability derived from any incident that may occur in the servers and security systems as a direct consequence of negligent or malicious action on their part.
Intellectual Property of Hosted Contents
The use of services provided by Uktena contrary to the legislation on intellectual property and, in particular, the following is prohibited:
The use of the domain's email server and email addresses for sending unsolicited bulk emails is prohibited. The user is fully responsible for the content of their website, the information transmitted and stored, the hypertext links, third-party claims, and legal actions concerning intellectual property, third-party rights, and child protection. The user is responsible for compliance with the laws and regulations in force and the rules related to the operation of the online service, electronic commerce, copyright, public order maintenance, and universal principles of Internet use. The user will indemnify Uktena for expenses incurred from Uktena’s involvement in any cause attributable to the user, including legal fees and expenses, even in the case of a non-final judicial decision.
Protection of Hosted Information
Uktena makes backup copies of the contents hosted on its servers, but it is not responsible for the accidental loss or deletion of data by users.
Similarly, it does not guarantee the complete replacement of the data deleted by users, as such data may have been deleted and/or modified during the time elapsed since the last backup.
The services offered, except specific backup services, do not include the replacement of the contents conserved in the backup copies made by Uktena, when this loss is attributable to the user; in this case, a rate will be determined according to the complexity and volume of the recovery, always with prior acceptance by the user.
The replacement of deleted data is only included in the service price when the content loss is due to causes attributable to Uktena.
Commercial Communications
In compliance with the LSSI, Uktena will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorized by the recipients of the same.
In the case of users with whom there is a prior contractual relationship, Uktena is authorized to send commercial communications regarding products or services of Uktena that are similar to those initially contracted with the client.
In any case, the user, after proving their identity, may request not to receive more commercial information through Customer Service channels.
